US Immigration and Naturalization Services
As a general rule, nationals of countries participating in the Visa Waiver Program (VWP) need not obtain a visa to perform regular business activities in the US. These countries are Andorra, Australia, Austria, Belgium Brunei, Denmark, Finland, France, Germany, Iceland, Ireland, Italy, Japan, Liechtenstein, Luxembourg, Monaco, the Netherlands, New Zealand, Norway, Portugal, San Marino, Singapore, Slovenia, Spain, Sweden, Switzerland, and the United Kingdom. Nationals of other countries will need a visa to perform business activities in the US, most likely the B-1 visa.
This visa is somewhat unusual as it allows the holder to work in the US, yet does not require the filing and approval of a petition to the US Citizenship and Immigration Services like most work visas do. It also does not involve a US employer. This may in rare circumstances cause problems when the holder enters the US. Please consult with one of our US immigration specialists for more information concerning this issue.
There are two types of E visas, E-1 Treaty Trader and E-2 Treaty Investor. The basis for the classifications lies in treaties of friendship, commerce and navigation or Bilateral Investment Treaty or other arrangements between the US and certain countries that were entered into to enhance or facilitate economic and commercial interaction between the US and the relevant countries.

A bona fide marriage to a US Citizen may be the safest and sometimes also the quickest way to a US green card. For immigration purposes, spouses of US Citizens are considered to be in the so-called Immediate Relative category, which enjoys some advantages compared to other preference categories. In particular, there are pronounced procedural benefits where the US Citizen spouse is residing in the UK.
Generally, the H-1B visa is designed to enable US employers hire foreign workers in specialty occupations on a temporary basis. A specialty occupation is one that requires (a) the theoretical and practical application of a body of highly specialized knowledge and (b) the attainment of a bachelor or higher degree in the specific specialty (or its equivalent) as a minimum for entry into the occupation in the US.
Generally, representatives of the non-US media traveling on assignment to the United States require “I” classification visas. They are not eligible to travel visa free under the Visa Waiver Program or enter the United States on B-1 business visas. Those who attempt to do so may be denied admission to the United States by immigration authorities at the port of entry.
This category facilitates transfer of employees between two or more existing or related companies: One in the US and one overseas. This is also for transfers of employees between a non-US company and a planned US subsidiary.
The O-1 visa category is meant for individuals having extraordinary ability in the sciences, arts, education, business or athletics and also for individuals involved in motion picture or TV production having a demonstrated record of extraordinary achievement.
Generally, the P-1 visa is suitable for individual or team athletes that are internationally recognised. The athlete must enter to US to participate in a competition, event or performance. This includes promotional appearances and can also include an entire season.
The R-1 visa category is suitable for religious ministers and for persons working in a religious vocation or occupation. The person must be entering the US to work in one of these religious capacities.
Student Visa in US
With the student visa season fast approaching, students and their parents are beginning to feel pressured. The most common concerns are the unavailability of visa dates and being rejected by the visa officer. Are these concerns justified?
"There is unnecessary hype about student visas. I went for my US visa interview and was practically asked nothing. The visa process has been simplified and my advice to applicants is -- don't make a big deal about your visa and just apply with all the papers that you have," says Aniket, a student who was just granted a US student visa.
"We make every effort to ensure that all students planning to study in the United States get their visas on time. In fact, we have established separate procedures in each of our four Consulates to handle the large number of student visa requests during the months leading up to the start of the academic year," states a US Consulate Officer.
So what is the US consulate doing to encourage more students to apply?
"The US Consulate is doing everything possible to assist qualified students obtain US visas. Specifically, student visa applicants receive expedited appointment dates, currently within three weeks of completing the visa application and paying the required fee. In addition, visa officers work hard to reach potential students with information about the visa process through question and answer sessions, seminars, and published articles on the visa process," said the US Consulate General.
The most important part of your US visa application process is your visa interview. Consulate officials have always advised applicants not to memorise answers for the visa interview. Instead, speak honestly and openly about your reasons to study in the US, your career goals and your finances. You should be prepared to answer any questions pertaining to your parents, your sponsor and the school you plan to attend. Be honest, confident and straightforward in your answers and your visa interview will be a cakewalk.
If you are planning to apply for a 'high tech' field such as Chemical Engineering or Advanced Quantum Physics at the Master's or Doctorate level, there is a good chance that your visa processing will take longer. In such cases, approval from Washington DC is required and hence applicants applying for visas in these fields are advised to apply as early as possible. Please keep in mind that if you are applying for these fields, it does not mean that you visa interview will be more difficult, it just means that the visa processing will take more time.
Students often believe that if their standardised test scores are low or if they have not appeared for any standardised exams, they will gave a hard time getting a student visa. Again, this is not true as the consulate is aware that certain programmes in the US do not require any standardised tests and hence the consulate reviews your visa application individually. Similarly, there are no 'blacklisted' colleges in the US and as long as your college is accredited and issues an I-20, you could qualify for your student visa.
"No single factor determines whether a student applicant qualifies for a US visa. Consular officers may look at test scores, finances, student history, and many other factors, but each interview is an individual interview and there is no minimum test score requirement that student applicants must meet. If a university has admitted an applicant, the Consular officers give due consideration to the determination by the admissions board in making their own determination of visa eligibility," states a US Consulate visa officer.
Students with last names of Patel, Shah, and Mehta stress more about their visa interview anticipating greater problems solely because of their last name. This, by far, is the greatest myth surrounding the US visa for many years now. The US consulate on several occasions has stated that this is a myth and certainly not true. Each applicant is reviewed independently and a particular last name cannot disqualify you for a visa. For example consider the student visa application of Rahul Patel. Rahul's mother, father and brother all live in the US and in addition, Rahul does not have sufficient funds to pay for his education. Rahul is not sure why he wants to study in the US and his main goal of getting to the US is to live with his parents. When Rahul applied for his US visa, his visa was denied. Now, was his visa denied because his last name was Patel?
Your visa can be denied under two sections -- Section 221 (g) and Section 214 (b). Section 221 (g) implies that there is some 'procedural' problem with your visa application and after correcting the problem, your visa may be issued. Examples of this include an invalid SEVIS fee receipt or a missing bank document. A denial under section 214 (b) implies that you are a potential immigrant and you have not convinced the visa officer that you plan to return home after your education. If your visa is denied you can apply again; there is no limit to the number of times you can apply for your student visa.
Final words of advice from the US Consulate General, "As with all visa applicants, student visa applicants should apply as early as possible for their interview date. In addition, student applicants should relax during their interview and be prepared to explain honestly why they want to go to a particular university and how that choice fits into their overall life plan."
As the student visa season approaches people will tell you that Friday is not the best time to apply for your visa as consular officers want to leave early for their weekend and hence will deny all visas after 2.00 p.m. You will also hear about the Chinese or African American lady who sits at 'Counter number 4' and denies visas to all students.
Finally, 'your uncle's friend's son's wife's brother' knows someone at the US consulate and promises a student visa for a ridiculously high sum of money. Please do not succumb to such rubbish and use your common sense before believing such rumours.
During the 'visa season', it is normal for your anxiety levels to reach an all time peak but understand that there is nothing tricky about the student visa process and by following simple guidelines, you most likely will get your visa.

The Right to Work & Study in Ireland:
As a visa student in Ireland, you must register as a full-time student with the Garda National Immigration Bureau (GNIB - The Irish Police) and then you will also be permitted to work part-time in Ireland (up to a maximum of 20 hours a week and full-time during vacation periods) to support yourself. Student Visa in Denmark
Foreign nationals may obtain a residence permit with a view to study in Denmark.
In accordance with the Aliens Act a residence permit with a view to studies or another educational purpose may be granted to
- students at post-secondary educations (a.k.a. tertiary studies)
- students at basic and youth study programmes
- students at folk high schools
- students at preparatory/foundation courses
Post-Secondary Educations (A.K.A. Tertiary Studies)
An educational programme is considered to be post-secondary education when the conditions for admission require that the student has completed a high school education or the equivalent.
Please observe that some of the educational programmes in English in commercial and technical schools are post-secondary educations.
In order to obtain a resident permit the applicant must document:
- that he/she has been admitted to a post-secondary education - the applicant must show an original admission letter or an original "purple form" if the applicant has been admitted to a university or the like
- that he/she as a minimum has paid the tuition fee for the first semester of the educational programme and can document to be in possession of sufficient means for the payment (Exchange students from an Australian or New Zealand university, who do not have to pay the tuition fee in Denmark must produce documentation that he/she has sufficient means for maintenance. The documentation should be original bank documents in the applicant's own name)
- that he/she can speak and understand the language of the instruction and can understand Danish, Swedish, Norwegian, English or German at a reasonable level.
Some post-secondary education programmes in Denmark will present the exchange student with the so-called ‘purple form’ - the name refering to the colour of the form. These educations are among others Universities, Copenhagen Business School, Aarhus School of Business, the Royal Danish Academy of Fine Arts and the Technical University of Denmark. The Consulate General in Sydney has a special authorization to issue the residence permit for Australian and New Zealand citizens who submit their application with the purple form. In these cases the processing will take about 2 weeks.
Other education programmes in Denmark does not supply the purple form. These educations are among others nursing schools and Vitus Bering. Applications without the purple form will be forwarded to the Immigration Service in Denmark and the processing takes about two months.

Work permits for students at Post-secondary educations
As a student you have the option of applying for a work permit which will allow you to work for 15 hours a week alongside your studies and to take on full time work during the months of June, July and August. You simply have to tick the ‘Work permit’ box on page one of your application for a residence permit.
All work permit applications are processed by the Immigration Service in Denmark, so even if you do have a purple form and the Consulate General in Sydney are authorized to issue your residence permit, we are NOT authorized to issue the work permit. It will therefore take up to two months for your work permit to be processed.
Basic and Youth Study Programmes
In order to obtain a residence permit the applicant must document:
- that he/she has been admitted to a basic- or youth study programme
- that he/she can support him-/herself during the stay (NB the documentation should be original bank documents in the applicant's own name)
- that he/she can speak and understand the language of instruction and can understand Danish, Swedish, Norwegian, English or German at a reasonable level
- that the holder of custody has given his/her consent if the applicant is under the age of 18 years old
- if the applicant is under the age of 18 years old, the educational institution must have made a declaration stating that it will help to ensure that the applicant has a secure stay in Denmark for the duration of the residence permit.
Work permits for students at basic- and youth study programmes
If you are under the age of 18, you are only eligible for a work permit if you have a written offer or contract for a specific position, and if the employer confirms to the Immigration Service that workplace environment legislation is upheld.
Preparatory or Foundation Courses
In order to obtain a residence permit the applicant must document:
- that he/she has been admitted to a preparatory or foundation course connected to a post-secondary education
- that he/she can support him-/herself during the stay (NB the documentation must be original bank documents in the applicant's own name)
- the he/she can speak and understand the language of the instruction and can understand Danish, Swedish, Norwegian, English or German at a reasonable level.
Folk high schools
In order to obtain a residence permit the applicant must document:
- that he/she has been admitted at an approved folk high school or the like
- that he/she has paid the course fees
- that he/she can speak and understand the language of instruction and can understand Danish, Swedish, English, Norwegian or German at a reasonable level.
BASIC AND YOUTH STUDY PROGRAMMES
- your passport
- two copies of the completed application form for a residence permit (can be downloaded from this website).
- two passport photos (3.5 x 4.5 cm. photo quality - please NO home made digital prints).
- two copies of a guarantee form from the youth study organisation
- two copies of the acceptance letter from the school or programme in Denmark
- two copies of parental consent/financial guarantee if the applicant is under 18 years of age.
- two copies of birth certificate
- a prepaid registered return envelope within Australia and please DO NOT remove the sender slip - that is for us to keep as proof of returning your passport.
- Application fee: Australian citizens AUD 154.00, New Zealand citizens AUD 164.00*. Payment should be made in cash, cheque or money order issued to the Danish Consulate General and it must be issued in AUD.
* The extra AUD 10.00 cover the postage for returning the passport to New Zealand and New Zealanders should therefore not enclose a return envelope.
NOTE: Listed Application fee effective from 1. August 2007.Kindly ensure that we have 2 sets of all papers and the application form and please refrain from using staples.
Furthermore you must ensure that your passport is valid for at least three months longer than your intended stay in Denmark.
For certain Basic and Youth Study Programmes such as Rotary, Youth for Understanding, Aspect and STS the Danish Consulate General in Sydney has special authorization to issue the residence permit. In these cases the processing will take about two weeks. For other organisations the application will be forwarded to the Immigration Service in Denmark and it may take up to 2 months before a reply is received.

How to Restore iPhone with Old 1.0.2 Firmware Skip or Bypass 1.1.1
Sometimes, due to some issues or troubleshooting requirement, you may need to restore the iPhone. However, you also have to avoid or bypass firmware update 1.1.1 and only restore using version 1.0.2 instead. In this case, follow the steps in the following guide to restore the iPhone using firmware 1.0.2.
Well, the steps are actually pretty similar to how to restore the iPhone normally, and the steps to downgrade from 1.1.1 to 1.0.2.
- Turn off iPhone - Hold down the Sleep/Wake button for a few seconds until the red slider appears, then slide the red slider. Ignore this step if your iPhone is already off.
- Press and hold down the Home button for about 10 seconds until a yellow triangle with a text which says Please Connect to iTunes appears.
- Plug the iPhone into Mac or Windows PC. Release the button if you haven’t.
- Run and open iTunes if it’s not already opened yet.
- iTunes will prompt a message that says iTunes has detected an iPhone in recovery mode. Click OK.
- You will be taken to the iPhone pane. Hold down the Options key (in Mac) or Shift key (in Windows) and then click on Restore (note that when the button should be pressed until Restore is clicked).
- Step above will oepn up a window to allow you to select the firmware software file you would like to use to restore to iPhone. Browse through the folders (Located in ~/Library/iTunes/iPhone Software Updates in Mac OS machine), and select the old firmware file named as iPhone1,1_1.0.2_1C28_Restore.ipsw.
- Wait for the full restoration process to complete, and the iPhone will be restored to state based on firmware 1.0.2, rather than performing the default action to automatically updating the phone to the newer 1.1.1 when you restore using iTunes.
Exit and Quit from Frozen or Hanged iPhone Application Program
To terminate a frozen and unresponsive iPhone program, hold down the Home button when in the application for 6 seconds to kill the slow running program.
If the trouble making is successfully closed, the iPhone can be used right away without restarting or resetting the phone again.
